## Private Jet Tax Guide 

**Tax note:**This guide is general educational information for U.S. aircraft owners and buyers. Aircraft tax treatment depends on ownership, business use, passengers, operating structure, state exposure and transaction timing. Obtain aircraft-specific advice from qualified aviation tax counsel and a CPA before closing or claiming deductions. 

A private jet can create substantial federal and state tax consequences long before the first flight. The purchase price may be depreciable. Business flights may generate deductible operating expenses. Personal flights can create taxable fringe benefits and deduction disallowances. The state where the aircraft is delivered, based and operated can determine whether millions of dollars of sales or use tax becomes payable. 

Tax planning therefore belongs at the beginning of a private aircraft acquisition, alongside financing, legal structuring, insurance and the pre-purchase inspection. An ownership entity created after closing cannot always repair a sales tax problem or depreciation mistake created when the transaction was originally structured. 

The U.S. tax environment became particularly significant for aircraft buyers after legislation enacted in 2025 permanently restored **100% bonus depreciation** for eligible depreciable property acquired after January 19, 2025\. The IRS subsequently issued Notice 2026-11 with additional guidance. Qualified new and certain used business aircraft can fall within these rules, but owning an aircraft through a business is not enough by itself to qualify.

Aircraft tax planning can involve federal income tax, depreciation, state sales and use tax, personal-use rules, leasing taxes and international exposure. 

2026 U.S. Tax Position 

A Business Jet Can Produce Major Tax Deductions, but the Flight Records Have to Support Them 

The IRS currently allows a 100% additional first-year depreciation deduction for eligible qualified property acquired and placed in service after January 19, 2025\. New and certain used aircraft may qualify. 

Business aircraft are also subject to special qualified-business-use tests under IRC §280F. Personal and entertainment use, related-party use and poor recordkeeping can reduce deductions or trigger depreciation recapture. 

Federal Income Tax 

## Can You Write Off a Private Jet? 

Potentially, but "write off a private jet" compresses several separate tax rules into one phrase. 

Business expenses generally need to be ordinary and necessary expenses of carrying on a trade or business. The IRS also requires personal expenses to be separated from business expenses. A corporation cannot convert family holidays or recreational travel into deductible business aviation simply by putting the aircraft inside an LLC. 

Aircraft acquisition cost is normally a capital expenditure rather than an ordinary operating expense. The tax benefit comes principally through depreciation, including accelerated depreciation where the relevant requirements are met. 

The distinction is important. A USD 20 million deduction does not make a USD 20 million aircraft free. It reduces taxable income according to the taxpayer's individual circumstances and applicable tax rates. 

## Business Aircraft Tax Deduction 

When an aircraft is genuinely used in a trade or business, deductible costs can potentially extend beyond depreciation to ordinary operating expenses allocable to qualifying business activity. 

Depending on the facts, these may include fuel, crew, management, insurance, hangar, maintenance, navigation, communications and other ordinary operating expenses. Capital improvements and certain major expenditures may instead need to be capitalized. 

The commercial reason for using private aviation should also be defensible. Reaching several facilities in one day, serving locations with poor airline connectivity, carrying employees or equipment and protecting executive time can present very different facts from using an aircraft primarily for personal convenience. 

The IRS requires contemporaneous substantiation for business aircraft, including the amount of expenses, time and place of travel, business purpose and business relationship of individuals traveling aboard the aircraft. 

Depreciation 

## Private Jet Depreciation 

Depreciation lets an aircraft owner recover the depreciable tax basis of a qualifying business aircraft over time. 

Under the IRS depreciation classifications, noncommercial airplanes are generally five-year property under the General Depreciation System. Asset Class 00.21 covers airplanes other than those used in commercial or contract carriage of passengers or freight and gives those aircraft a five-year MACRS recovery period. 

Aircraft primarily used in commercial or contract air transportation can fall into a different asset class and generally use a seven-year MACRS period. Under the Alternative Depreciation System, noncommercial aircraft generally have a six-year recovery period while commercial aircraft generally use 12 years. 

The correct class is driven by actual use. An aircraft owned principally for internal corporate transportation does not automatically receive the same depreciation treatment as an aircraft principally leased into commercial charter service. 

## Private Jet Bonus Depreciation in 2026 

This is currently the headline federal tax provision for many U.S. business aircraft buyers. 

The IRS states that qualified property acquired and placed in service after January 19, 2025 can receive a **100% additional first-year depreciation deduction**. Qualified property can include new and certain used property. 

Legislation enacted in 2025 removed the scheduled phase-down for this category of property. The IRS issued [Notice 2026-11 ](https://www.irs.gov/irb/2026-06%5FIRB?ref=acmiworld.com)with interim guidance on the revised rules. 

The operative phrase is **qualified property**. Business-aircraft owners must still satisfy the special business-use tests, acquisition rules, placed-in-service requirements and other provisions applying to their circumstances. 

Aircraft acquired under older contracts can present more complicated transition questions. That is precisely the type of transaction where specialized aviation tax counsel should review the purchase agreement and delivery facts before the return is filed. 

Simplified Example 

USD 15 Million Business Jet 

Assume a company purchases an eligible USD 15 million used business jet after January 19, 2025, places it in service and satisfies all requirements for 100% bonus depreciation. 

The company could potentially claim a first-year depreciation deduction based on the aircraft's qualifying depreciable basis rather than spreading the entire deduction across the ordinary MACRS schedule. 

That does not automatically create USD 15 million of cash savings. The economic value depends on taxable income, basis, limitations, business use, entity structure and the owner's overall tax position. 

## Qualified Business Use Is Critical 

The IRS specifically treats business aircraft as listed property for accelerated-depreciation purposes. 

To claim accelerated depreciation, including the special depreciation allowance, a business aircraft must satisfy both the 50% test under IRC §280F(b) and the additional 25% test under §280F(d)(6)(C)(ii). 

These calculations can become much more complicated than simply dividing annual business flight hours by total flight hours. IRS guidance requires passenger-by-passenger analysis on each flight leg, and certain related-party, entertainment or compensation uses may not count as qualified business use even when another business-use calculation treats the trip differently. 

If qualified business use later falls to 50% or below, depreciation recapture can become an issue. Large first-year deductions therefore make continued flight-record compliance even more important.

The table is a starting point rather than a depreciation opinion. Leasing arrangements, primary use, elections, foreign use and other facts can change the correct schedule. Corporate Aircraft 

## Personal vs Business Use of Corporate Aircraft 

Personal use does not automatically make corporate aircraft ownership impossible, but it changes the tax analysis. 

The IRS states that personal use of company aircraft by an employee or their guests is generally a taxable fringe benefit to the employee. Valuation can involve the Standard Industry Fare Level, commonly called SIFL, or fair charter value depending on the applicable rules and method. 

Separately, IRC §274 can disallow corporate deductions associated with certain entertainment use. The income included on an executive's W-2 and the expense disallowed to the company are not necessarily equal. 

This is one of the areas where aircraft taxation differs sharply from ordinary company travel. Each passenger and each leg can matter. 

Aircraft owners with executive or family use should maintain an aircraft-use policy and classify flights contemporaneously instead of asking the accounting team to reconstruct the entire year's passenger manifest after December 31\. 

State Tax 

## Private Jet Sales Tax 

There is no single U.S. aircraft sales tax rate. 

Aircraft sales and use tax is principally a state issue. Rates, exemptions, delivery requirements and documentation vary significantly between jurisdictions. 

Deloitte's U.S. private-aircraft tax review notes that aircraft sales can be subject to sales and use tax in 45 states and the District of Columbia unless an exemption applies. Some jurisdictions provide broad aircraft exemptions. Others offer exemptions based on leasing, resale, interstate commerce, fly-away rules or specific operational requirements. 

This is why the planned delivery location should be reviewed before the purchase agreement becomes unconditional. Taking delivery in the wrong jurisdiction and trying to restructure afterward can be expensive. 

## Aircraft Use Tax 

Avoiding sales tax at closing does not necessarily eliminate state tax exposure. 

A state can impose use tax when an aircraft purchased without sales tax is subsequently stored, based or used inside that state and no exemption applies. 

Owners therefore need to analyze more than the FAA registration address or state where the aircraft-owning LLC was formed. Hangar location, flight activity, delivery, ownership, leasing arrangements and state-specific statutes can all matter. 

States can also impose annual personal property or similar taxes on aircraft. A Delaware LLC does not by itself neutralize tax exposure in California, Florida, Texas or another state where the aircraft actually operates. 

## Private Jet VAT 

The United States does not operate a federal VAT system, but VAT becomes highly relevant when a U.S.-owned aircraft is imported into or operated through jurisdictions that impose value-added tax. 

European and other international aircraft transactions can involve import VAT, customs status, temporary admission, leasing treatment and questions over whether the aircraft qualifies for exemptions associated with particular commercial operations. 

Cross-border aircraft should therefore be reviewed by advisers familiar with both U.S. structuring and the jurisdiction into which the aircraft is being imported. This is particularly important for family offices and businesses purchasing aircraft in the United States for substantial European use. 

Leasing 

## Aircraft Leasing Tax Treatment 

Leasing can be an operational decision, a financing decision and a tax decision at the same time. 

A genuine dry lease normally provides the aircraft without crew. Depending on the jurisdiction and structure, state sales or use tax may apply to the lease payments rather than the original acquisition. Lease-for-resale exemptions can sometimes affect the initial purchase. 

When the aircraft provider also supplies crew or retains sufficient possession, command and control, the transaction can create federal air transportation excise tax issues. Tax characterization and FAA regulatory characterization also need to be analyzed together rather than independently.

## Private Jet Ownership Structure for Tax Purposes 

Aircraft are frequently held in a special-purpose LLC. That can be useful for title, financing, privacy and liability planning, but an LLC is not a tax strategy by itself. 

The correct structure depends on who will use the aircraft, who pays for it, which entity conducts the operating business, whether intercompany leases are contemplated, whether third-party charter will occur and which states the aircraft will enter. 

A structure designed solely around sales-tax savings can create federal income-tax or FAA problems. Conversely, putting the aircraft directly into an operating company without analyzing liability, privacy and future sale considerations can be unnecessarily restrictive. 

Common structures can involve disregarded LLCs, partnerships, corporations, trusts and leasing entities. The correct choice is fact-specific.

Transaction Planning 

Tax Implications of Private Jet Ownership Extend Beyond the Purchase 

Acquisition tax planning receives the most attention because the numbers are large. The tax file continues for as long as the aircraft is owned. 

Owners need ongoing flight classifications, depreciation calculations, SIFL reporting where applicable, state filings, lease and FET analysis, property-tax reviews and planning for the eventual aircraft sale. A large bonus-depreciation deduction can also create significant depreciation recapture considerations when the aircraft is later disposed of.
